Terms and Conditions |
Elegibility to purchase |
Only parties who can lawfully enter into and form contracts (in accordance with English law) are allowed to purchase merchandise through Angeline Tournier Ltd trading as Angeline Tournier ("the Seller") on our website or by telephone ("the Site").
In order to make purchases through the Site, you ("the Buyer") will need to register and provide your personal details. By entering your payment details, you represent and warrant to the Seller that 1) the payment details you provide are both valid and correct and 2) you are the person referred to in the Billing section of the site.
You are only allowed to make a purchase on the Site if you meet the Seller's terms of eligibility, you have been issued a valid credit card by a bank acceptable the Seller, and you have authorised the Seller to process a charge or charges on your credit card in the amount of the total purchase price for the merchandise which you purchase (plus shipping and where applicable VAT). You are only allowed to make purchases on the site for your personal and/or gift use. You are not allowed to use any purchases from the Site for re-sale, commercial purposes or any other commercial benefit.
By making an offer to purchase merchandise, you expressly authorise the Seller to perform credit checks and, where the Seller feels necessary, to transmit or to obtain information about you to or from third parties from time to time.

Orders |
All orders are subject to acceptance by the Seller and availability. Occasionally, the Seller may be waiting for shipments of products from the manufacturing factory. Consequently you may from time to time be given the possibility of making an advance payment by clicking on Pre-Order (in the left hand column tool bar). This will ensure that you receive this item once the stock has been delivered to the Seller. The Seller will only take Pre-Order purchases for stock that has been scheduled for delivery by the factory. Your rights regarding Pre-Orders are the same as those for any other purchase from the Seller; alternatively you may simply choose to register your email address for notification of arrival of the selected merchandise not held in stock by clicking on Notify Me (in the left hand column tool bar).
Items received into stock may be pre-allocated to satisfy Pre-Orders. Customers making Pre-Orders will receive items in priority to other customers. Sometimes we may be unable to deliver selected Pre-Orders merchandise due to production problems or quality check issues identified when we receive an order into stock. In these circumstances we will notify you by email and refund the advance payment to your credit card within thirty days of being advised that the merchandise has become unavailable.
If you have registered your email address for notification of the arrival of a specific product featured on our website, we will attempt to notify you by email as soon as possible after the product becomes available on the Site (but we give you no guarantees that we will notify you). Sometimes, certain products may sell out before we have a chance to notify you.
Prices shown on the site are in GBP. VAT will be added on top of the stated GBP price, for deliveries to the UK and EC Europe. If you are buying from outside the UK, you may also incur duties levied by the jurisdiction to which you have specified delivery (but no VAT). All products have shipping charges added on top (plus VAT where applicable). The final price for overseas customers will be calculated in accordance with the applicable exchange rate on the day your credit card company processes the transaction.

Acceptence of Orders |

Acceptance of your order and completion of the contract between you and the Seller will be perfected on the date we despatch the goods to you.
We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorisation for payment, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn or that you do not meet our eligibility criteria. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site for any reason; removing or editing any materials or content on the Site; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

Payment |

Payment can be made by the cards outlined in the payment page (see the top toolbar). We will debit the amount of the payment from your card account when we receive your order. You confirm that you are using your own personal credit/debit card. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to the Seller, we will not be liable for any delay or non-delivery.
We take all reasonable care to keep the details of your order and payment secure. All credit card transactions on this site are processed using Worldpay. The Supplier does not hold your credit card details on the website or our customer database. We do not accept liability for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Site (unless we are grossly negligent).

Onus of responsibility for the product |

Your order will be delivered by our partner courier company. Responsibility for your purchased goods passes to you when the courier company delivers your purchase to the delivery address (whether or not you or a third party signs for the delivery).

Returns & refunds |
For returns, please follow the instructions contained in the Returns page, under the On-line shop information, in the top hand tool bar. If you want to exchange an item please 1) email us your required size and we will reserve it for you if the item is in stock 2) return the original item as described above (for a refund) and 3) purchase the replacement size by following the normal purchase procedure.
All returned goods will undergo a quality control check. Please see the Returns page, under On-line shop information, in the top hand tool bar, for details of the condition in which returned products need to be received by the Seller to be accepted as a valid return by the Seller.
Please check products thoroughly upon delivery before removing any attached tags and before disposing of any original packaging.
In the event of any failure to return any goods to us within the stipulated time limits, we shall have the right to charge you any costs of recovery of the goods.
Please be aware that international customs duties and sales taxes are NOT refunded for shipments outside the European Community (EU).
Faulty items will only be accepted 1) if there is a manufacturing fault and 2) the faulty item is returned to us within a period of 6 months after the date when we deliver the item to you. All items returned as faulty will be inspected and any items deemed to subject to fair wear and tear will not be accepted as faulty. Please note that all items are carefully inspected before they are sent to you, to check for any visible signs of damage or faults. We do not accept any liability for any damage to the product after it is delivered to you.
Where possible items may be repaired on request but only where such items are deemed faulty and repairable. Repairs do not come with any guarantees.
Refunds to you will be made within 30 working days of the receipt by the Seller of the returned product. All undamaged, correctly returned products will be credited to the original purchaser's credit card (including VAT for UK and EU country shipments) but excluding shipping charges, international customs duties and sales taxes.
If you have received an item from the Supplier as a gift you can return it in exchange for a store credit to your Supplier account (you will need to register with us). You will be required to pay any difference in cost and any additional shipping, taxes and import duties. Any unused credit will remain on your account until your next purchase.

Privacy |

If an order is placed with us, we need to hold personal information (e.g. your name, e-mail address, phone numbers, home address etc) so that we can process and fulfil your orders. Credit card details are entered directly into Worldpay's system and are not transmitted or held on our system. Additionally we may also obtain information as a result of authentication or identity checks. Your delivery address and telephone number may be given to our courier for delivery services.
We may collect non-personal data about use of the website (e.g. pages visited, times and volume of use of the services, time of log-on etc). Our site may use cookies to keep track of how often you visit our site, the contents of your shopping cart, previous purchases etc.
The Seller may use your personal information for the processing of orders and to fulfil and deliver your orders and manage your account. Your personal information may also be checked with credit agencies to prevent fraud. Where there is a legal obligation to do so, we may disclose your information to any relevant regulatory body.
Finally, we may use your personal information for our internal marketing and demographic studies.

We make no warranty that this Site will meet your requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that this Site or the server that makes it available are free of viruses or bugs. We are not responsible or liable to you for any loss of content or material uploaded or transmitted through this Site or for any problems you or a third party experiences in connection with the use of the Site. We cannot guarantee and are not in any way responsible for the security or privacy of the Site and any information provided to or taken from the Site by you.
To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the products available through the Site including but not limited to, implied warranties of satisfactory quality and fitness for a particular purpose. Nothing in these terms & conditions shall limit your rights as a consumer under English law.
Except for death and personal injury arising from our direct gross negligence or fraudulent representation made by the Seller, we are not in any way liable (including but not limited to contract, tort, negligence), for any loss (including but not limited to loss of revenues, profits, contracts, business or anticipated savings, any loss of goodwill or reputation, or any special or indirect or consequential losses of any nature) incurred by you or a third party arising from the direct or indirect use of the Site or products sold on the Site.

For the avoidance of doubt, there exists no joint venture, partnership, employment, or agency relationship between you and the Seller as a result of the terms of the Site and/or your use of this Site.

If any part or parts of the Site or terms & conditions are invalid under UK law, only that part or parts shall deemed to be invalid and the rest of the Site and terms & conditions remain valid and binding on you, by virtue of you visiting the Site.
No verbal information given to you by any party shall in any way alter the terms & conditions of the Site. By viewing the Site, you accept the terms & conditions, you confirm that you have not relied on any verbal representation and you agree that you shall have no remedy in respect of any verbal misrepresentation made by any person regarding the Site or its products.
